Available Driver

The coverage consists of $50,000 for bodily injury (per person), $100,000 for total bodily injury (per accident), and $25,000 for total property damage (per accident).

Driver Has Passengers or Is on the Way to Passengers

When a rideshare driver has accepted a ride request and is on the way to passengers, or actively has passengers in the car, the rideshare company will have higher insurance coverage. The coverage for this working phase is up to $1 million in third-party liability coverage.

Unavailable Driver

When a rideshare driver is logged out of the app and unavailable, the driver is not covered by the rideshare company’s insurance policy. Anyone who is involved in a car accident with an offline rideshare driver will only be able to recover from the driver’s personal insurance policy.

Unlike traditional employers, rideshare companies are not liable for the acts of their drivers because their drivers are only classified as independent contractors. A traditional employer will be subject to the legal theory of respondeat superior, which states that all employers are liable for their employees’ actions on the job. However, independent contractors are not subject to this theory. As a result, victims of rideshare accidents must prove the working phase of the rideshare driver to recover any compensation from the rideshare company’s insurance policy.
